TERMS & CONDITIONS

Where referred to in these terms and conditions, “the client” means the bride and groom detailed on the photography booking form overleaf and “the photographer” means Dawn Dutton Photography Limited.

It is mutually agreed by the client and the photographer that the following terms and conditions form an integral part of this agreement:

1.        The photographer is retained by the client as the exclusive official photographer for the wedding of the client (“the wedding”).

2.        The wedding photography is only accepted and confirmed by the photographer on receipt of both the official booking form and a 
                     minimum $600 non refundable deposit. The balance of the wedding coverage fee must be paid by the client no later than 1 week
                     prior to the wedding date, unless other arrangements have been accepted by the photographer.

3.        The photographer agrees not to change the coverage fee once the booking has been confirmed. The client acknowledges however
                     that reprint and other ancillary product are normally subject to an annual price increase. The photographer constantly aims to
                     improve its customer service and therefore reserves the right to alter product specifications without notice.

4.        The photographer will hold provisional bookings for a period 5 working days before re-releasing the date.

5.        The client acknowledges and agrees that full payment is required with all re-orders.

6.        The photographer’s judgement regarding the number of images taken shall be final. Due to the vagaries of the weather and
                     the willingness of subjects the client acknowledges that it may not be possible to capture all the images requested.

7.        The client may cancel this agreement at any time by giving written notice to the photographer, but in doing so shall forfeit any 
                     monies already paid to the photographer.

8.        In the event of total photographic failure or cancellation of this agreement by either party, whether caused by negligence or in any 
                     other circumstances, the liability of one party to the other shall be limited to the total value of the agreement, and such amount
                     shall be in full and final satisfaction of any damage or loss suffered by either party. Neither party shall be liable for indirect or
                     consequential loss.

9.        Force Majeure or Act of God: The due performance of this agreement is subject to alteration or cancellation by either party owing
                     to any cause beyond their control.

10.     The client is responsible for the conduct of guests at the wedding.

11.      The client acknowledges that:
                   a.The photographer will not tolerate verbally or physically abusive behaviour, nor will it share its time or compete with guest
                         photographers for the attention of the subjects;
                   b.Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken 
                        and increase the number of times photographs must be re-taken; and
                   c. If the client is unable to control the conduct of  guests at the wedding resulting in an unacceptable degree of misconduct, or 
                        if the conduct of any of the client’s guests damages the equipment of the photographer, it will result in the early or immediate
                        departure of the photographer. The client agrees that in such an event, no refunds will be granted.

12.     The client is satisfied that the details overleaf are correct and the client will confirm venue locations prior to the date overleaf.

13.     The client agrees that:
                  a. The copyright in all photographs is owned by the photographer; and
                  b. The photographer may use any image from the wedding for display material in any media, including (without limitation)
                       literature, printed press, television, digital, website and marketing strategies or samples, displays, exhibitions, portfolios, 
                       competitions for promotion and advertising for the photographer.

14.     The photographer has no control over the environment in which the client keeps its photographs and shall not be responsible for
                  any deterioration of the client’s photographs. In common sensitized material and colour dyes have limited life expectancy when
                  exposed to strong and prolonged sunlight or fluorescent light sources. Photographs will retain their colour and brilliance much
                  longer when displayed under better lighting conditions.

15.     The client shall pay the photographer using one of the following payment methods: cash, cheque (payable to: Dawn Dutton
                  Photography Limited) or electronic funds transfer (National Bank: 06-0493-0465008-00)

16.     The photographer reserves the right to alter any part of this document, our website, literature and promotional/advertising 
                  material at any time and without notification.

17.     LIMIT OF LIABILITY: In the unlikely event of severe medical, natural or other emergencies, the client acknowledges that it may be
                  necessary for the client to retain an alternative photographer, in which event the photographer will make every effort to secure a
                  replacement photographer able and or willing to provide a similar package as chosen in this agreement at the same/similar tariff.
                  If  such a situation should occur and a suitable replacement is not found the photographer’s liability to the client shall be limited to
                  the return of all payments received for the event package.

18.     No variation or modification of this agreement shall be effective unless accepted by the photographer in writing.

19.     The photographer may terminate this agreement immediately if in the photographer’s sole discretion the client fails to comply
                 with any of these terms or conditions.
